Terms of service
Last updated 30 October 2026
These terms apply to businesses that use Brightwell Hub (“you”) and to the staff they invite. Brightwell Hub is run by Brightwell Solutions (“we”). By signing in or using the service you agree to them. Our privacy policy explains how we handle personal information.
The service
Brightwell Hub lets you keep a list of contacts, collect signups on your website, and send marketing, relationship and legal emails to the people on that list, including automated emails such as welcome series and cart reminders.
Accounts and access
Access is by invitation. Each person signs in with their own Google account. You decide who to invite and what they can do, you are responsible for what they do in your account, and you remove access when someone leaves. Tell us straight away if you think an account has been misused.
Sending email responsibly
You agree that you will:
- only send marketing email to people who agreed to receive it, or whom the law otherwise allows you to email, and keep a record of that consent;
- follow the laws that apply to your emails, such as Canada’s Anti-Spam Legislation (CASL), the US CAN-SPAM Act and privacy laws like the GDPR;
- identify yourself truthfully as the sender, include your postal address, and honour every unsubscribe (the service does this for you automatically);
- not use bought, rented or scraped lists, and not send spam, phishing, malware, or anything illegal, deceptive, hateful or that infringes someone else’s rights;
- not try to get around the service’s limits, consent checks or security, or interfere with other customers.
Your content and contacts
Your contact lists, emails, images and other content remain yours. You give us permission to store and process them only to run the service for you. You are responsible for having the right to upload them and to email the people on your list. Owners and admins can export your contacts from the Contacts page at any time, and you can ask us to delete your data.
Pausing and suspending
To protect delivery for everyone, the service pauses a campaign automatically when too many emails bounce or are reported as spam, until you review it. We may also pause sending or suspend an account that breaks these terms, puts the service or other customers at risk, or that we are legally required to stop. Where we can, we will tell you first and explain why.
Other services
The service relies on other providers, including Mailgun to deliver email, Cloudflare to protect signup forms, Google for sign-in, and your own online store and its plugins. Their own terms also apply to your use of them.
Availability
We work to keep the service running and your data safe, but it is provided “as is”. We cannot promise it will always be available or error-free, or that a mailbox provider will deliver a given email to the inbox.
Limits on liability
As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue or data, and our total liability to you for any claim is limited to the fees you paid us for the service in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Ending the service
You can stop using the service at any time. We may end it with reasonable notice, or straight away if these terms are seriously broken. When it ends you can ask for an export of your contacts, after which we delete your data as described in the privacy policy.
Changes
We may update these terms. We will change the date above and email the staff of each business about significant changes before they take effect. Continuing to use the service after that means you accept the new terms.
